Rising out of committee, it was reported that FSAs were discussed.

4.  REPORTS
a) President (Gaby Bureau):  Discussed the FSA vote on Dec. 9-10, at each school     or the union office; visits will be made to each school to speak about this.      Comments about the idea of offering extra prep time or NIDs to new teachers,     mentioned at Board Meeting; they can’t do this without Bargaining, as it is part of     the Contract.  Working groups on School Closures and on Class Size and     Composition are ongoing; the School Closure group will be presenting to the     Board in December, the other group possibly in February.  New contract is now     ready, new Staff Room binders will be reappearing soon; this is not the 2006-    2011 contract, but an older version.  There have been some changes to Benefits.      Thanks to Nick Adey and Elliott Fox-Povey for the work they have done keeping     us informed during the Municipal Election.

b) Bargaining (Kathy Murphy):  Short comments on Contract and ongoing issues.

c) L.R. (Joanna Larson):  Comments on FSA vote, with information from the RA.

4.  OLD BUSINESS
a) Constitution and By-laws:  Notice of changes was given at the May 2008     General Meeting.  Moved Murphy/Larson, that we adopt the changes     recommended for By-Law 4.14.                     CARRIED

b) Health and Safety: working alone (Tamara Thompson).  Inconsistencies from     school to school, differing interpretations of various rules, etc., so some new     protocols have been issued.  Also a plea for violence reports to be filled in and     submitted, as many are not bothering to file these.

c) Secondary Rep. for Bargaining Committee – Joanne Chrona has volunteered.

5.  NEW BUSINESS

b) Class size and composition and School closure working groups:  Please feel     free to participate, and fill in the surveys that come around or attend the meetings.
Moved E. Braid/Fox-Povey, that the PRDTU president investigate the possibility     of establishing an elementary segregated program(s) for students with exceptional     disabilities, and report back to the PRDTU Executive.        CARRIED

EXECUTIVE COMMITTEE RECOMMENDATIONS

Ad hoc RA Committee to Examine the Executive Committee Hiring Process

That the ad-hoc committee to examine the Executive Committee hiring process consist of five members of the Representative Assembly.

RA Ombudspersons

That the Representative Assembly annually elect at the Spring RA, up to three members who will be members of the Representative Assembly the following year to serve as ombudsperson(s) for meetings of the RA and AGM.

Grants to Locals

1. That a grant be established to assist locals prepared to take political and demonstrative actions to assert their right to free collective bargaining on matters of significant concern to the local and its members. The grant would cover costs related to a local campaign to obtain improvements for members to an amount of $25,000.

2. Additional costs for the campaign would be shared equally between the locals and the Federation.

3. Consent for the grant is by the Executive Committee upon application by a local that meets the following criteria:

a. the local has already initiated work on the issue and it has a profile in the district

b. the issue has provincial application

c. the application has been approved by a general meeting of the local

d. there is evidence of broad member support in the local for the issue.

4. Grants issued under this proposal would be a cost to the Collective Bargaining Defence Fund as per procedure 10.L.10 (i).

5. Grants approved under this proposal may be increased by a favourable vote of the Representative Assembly.

Agreement on Internal Trade

1. That the BCTF express its opposition to the labour mobility provisions of the Agreement on Internal Trade entered into by the premier and the commensurate lowering of qualifications for professional certification of teachers in British Columbia.

2. That the BCTF call for a full legislative debate and decision on any trade agreements contemplated by the provincial government.

3. That the BCTF call upon the College of Teachers to vigorously oppose the labour mobility provisions of the Agreement on Internal Trade and any further lowering of qualifications for professional certification for BC teachers.

4. That the BCTF call upon the deans of education to defend current qualification for professional teacher certification in BC.

LOCAL RESOLUTIONS

Professional Autonomy

Referral

That the following motion be referred to the Executive Committee for consideration with report back to the Winter RA:

That an edition of the BC Teacher magazine be devoted to professional autonomy highlighting how locals are fighting to preserve it.

Definition of a Classroom

That the BCTF lobby the Ministry of Education to change its capital funding definition of a “classroom” to include rooms used for programs that support student learning, such as ESL rooms, Learning Assistance rooms, computer rooms, art rooms, music rooms, etc.

Social Justice 12

That the BCTF support the student campaign in Abbotsford to convince their school board to offer the full Social Justice 12 course to all students who elect to take the course.

Collective Bargaining

That the BCTF begin preparation for the next round of collective bargaining and that these preparations include a review of the bargaining process, and recommendations for actions that will give locals greater scope for local bargaining.

TEACHING AND LEARNING ACTION PLAN

Foundation Skills Assessment

1. That, again, the minister of education be urged to:

a. bring an immediate end to the practice of ranking BC schools.

b. eliminate the compulsory administration of Foundations Skills Assessment tests to all Grades 4 and 7 students, by changing to a process of random sampling with neither schools nor students identified.

c. consult with the teaching profession to develop appropriate and educationally sound means of assessing BC’s education system.

2. That locals lobby MLAs, trustees, DPAC and PAC representatives, labour councils, and other union and community groups to help persuade the minister of education to make these changes.

3. That locals meet with superintendents and chairpersons of boards of education to discuss the educational and professional concerns of teachers related to the existing Foundation Skills Assessment program and to advocate for the foregoing changes.

FINANCE

Langley Special Education Inquiry

That the $8,000 final contribution to the Langley Special Education Inquiry be a charge against the Contingency Fund.

Langley Special Education Inquiry

That the amount charged against the Contingency Fund for the Langley Special Education Inquiry be up to $53,100.

Cuban Teachers’ Union

That the BCTF grant $20,000 to the teachers’ union in Cuban to assist in the reconstruction of more than 2,000 schools damaged or destroyed by hurricanes Gustav and Ike and that the grant be a charge to the Contingency Fund.

BC Citizens for Public Power

That $10,000 be donated to support the work of BC Citizens for Public Power and that this be a charge against the Contingency Fund.

Oxfam Canada’s China Earthquake

That the contribution of $10,000 to Oxfam Canada’s China Earthquake Response Fund 2008 be a charge against Contingency Fund.

Humanitarian Coalition for Aid to Burma

That the contribution of $10,000 to the Humanitarian Coalition for aid to Burma be a charge against the Contingency Fund.

GVTA Prep Time Action Plan

That costs related to the GVTA prep time action plan be a charge against the Collective Bargaining Defence Fund.

Farm Workers

That the $2,000 donation to the trust fund established for families of the farm workers killed on the mushroom farm earlier this fall be a charge to the Contingency Fund.

Mileage Costs

That the Finance Committee develop and implement a process for separating out mileage costs paid to members on BCTF business for the school year 2009–10 and report to the 2010 Fall RA.

GVTA PRESENTATION ON MIDDLE SCHOOL PREP TIME

Middle School Campaign

That the Federation continue to support the Greater Victoria Teachers’ Association middle school campaign as per the January Winter 2008 Representative Assembly resolution until January 1, 2009, and at that time a further $25,000 be made available, followed by matching funding for their campaign.

Support for GVTA Professional Autonomy Action Plan

That the BCTF provide full, legal, political, and moral support to the GVTA Professional Autonomy Action Plan and that the GVTA be requested to update the Winter RA on this campaign.

BCFED/CLC

Farm Workers

That the BCTF in solidarity with the BC Federation of Labour and the families of the workers killed or injured at Farmers’ Fresh Mushrooms Inc. on September 5, 2008 call on the province to hold a public inquiry on working conditions in the agricultural sector that would examine:

· the enforcement of health and safety standards in the agricultural sector.

· training requirements for agricultural workers.

· Language barriers that make agricultural worksites dangerous.

· The precarious nature of employment in the agricultural industry for workers on temporary foreign permits.

· Employment standards for agricultural workers.

· The recent deaths in the agricultural sector.

· Efforts to discourage the unionization of the agricultural workers.

The following were elected to Judicial Council:

Gary Egglestone (Nanaimo) (2 year), and Carol McQuarrie (Boundary) (1 year term).

The following were elected to the Committee of Ombudspersons:

AGM REFERRALS

Resolution 102—Policy 3.B.01.27

That Policy 3.B.01.27 be amended by replacing it with the following: Extended Health Benefit coverage for the professional services of clinical psychologists of at least $1,500 per calendar year.”

Resolution 104—Bargaining

That Policy B.01 be amended by adding: “That the BCTF bargain with the employer to have three days fully funded to release teachers to conduct teacher-initiated assessment.

Resolution 105—In-service Training

That the BCTF and its locals lobby boards to provide free in-service training during instructional hours with release time and TOC coverage for teachers in the areas of ESL/LAC and/or Special Needs.

Resolution 106—Use of Public School Buildings

That the BCTF oppose the use, sale, rental, or lease of closed public school buildings (or unused classrooms) to organizations that provide educational services that are in competition with public schools.

Resolution 132—ESL

That ESL service be provided for students for whom English is an additional language in French Immersion at the time that they begin the English component.

Resolution 133—Colour-vision-deficient Students

That the BCTF encourage the development of in-service training that offers strategies for working with colour-vision-deficient students. Such pre-service and in-service education should also sensitize teachers to the needs of colour-vision-deficient students.

Resolution 135—Grade-Group Meetings Attendance

That schools in which the principal has arranged time during the school day for collaboration in the form of Grade-Group meetings be at the teacher’s discretion.

Resolution 136—Grade-Group Meetings Agenda

That members who attend Grade-Group meetings insist that the choice of topics to be discussed be decided by consensus among the individual members attending.

Resolution 138—Voluntary Participation in PLCs

That members not support secondary school Professional Learning Communities unless they ensure that participation is voluntary, that members choose the topics and how the work of their group is reported.

Resolution 139—Education Leadership

That the BCTF research and develop a policy on school-based educational leadership for members.

Resolution 146—Sun Awareness

That BCTF members encourage students to wear hats and use sunscreen whenever they are participating in outdoor activities generally, and in particular during outdoor school activities.

Resolution 153—Solar Index and Air Quality Awareness

That BCTF members encourage boards of education to ensure that solar index warnings and air quality indexes be posted daily.

Resolution 154—Mental Health

That the BCTF establish a working group composed of both Executive Committee and BCTF members to investigate and advise the membership on how to promote and improve their mental health.

Resolution 155—Changes to School Act

That the BCTF develop recommendations for changes to the Independent Schools Act that assure the following:

1. that independent schools adhere to the BC curriculum

2. respect for the UN Charter on the Rights of Women and Children

3. that inspections are yearly, unscheduled, and conducted by educators who are not aligned with independent schools

4. that no government funds be provided to independent schools.

Resolution 156—Bountiful

That the BC government withdraw funding for the religious schools in Bountiful.

Recommendation 12—Policy 23.01

That Policy 23.01 be deleted.

Resolution 161—School Visit Grants

Referral

That the following motion be referred to the Executive Committee and the Finance Committee for consideration with a report back to the Winter RA:

That the Executive Committee of the BCTF consult with locals to determine a new formula for grants to support school visits on emergent issues. The criteria for the new formula would be to ensure that: resources are distributed judiciously but fairly, visits can be done in a timely manner, local geographic realities are accounted for, local timetable structures are factored in, and all local released officers are involved in visits.

FINANCE
Fee Recommendations – 2008-09
That the Representative Assembly recommend to the AGM:

That for the 2008-09 membership year, the fee for those members under By-law 1.1(a) shall be 1.45% of the actual salary of the member, allocated as follows:

1.31% to the General Operating Fund,
0.06% to the Collective Bargaining Defence Fund,
0.05% to the Public Education Defence Fund,
0.02% to the Provincial Bargaining Fund,
0.01% to the Contingency Fund

Except that the fee for active members who are teachers on call shall be 0.36% of the actual salary of the member allocated in the same ratio as above.

Other Membership Fees
That for the 2008-09 membership year, the fee for affiliate administrative membership under By-law 1.6, exclusive of the Salary Indemnity Plan, be $50.

That for the 2008-09 membership year, the fee for those who are members under By-law 1.2 (associate membership), shall be $50, except that the fee for associate members who are uncertificated teachers’ replacements shall be 0.36% of the actual salary of the member, and except that the fee for associate members who are students enrolled in programs of study in university/college programs leading to certification as teachers shall be $1.00.

That a member who is on leave of absence either without pay or on a deferred salary leave remains an active member, without payment of fees.

That for the 2008-09 membership year, the fee for those who are members under By-law 1.6 (affiliate membership) shall be an amount negotiated between the BCTF and the affiliate, on a fee-for-service basis.

That for the 2008-09 membership year, the fee for active membership for those who are members under By-law 1.1(b) shall be the same as the fee for active members under By-law 1.1(a), provided that the Representative Assembly may, in establishing policy regarding the eligibility of such members, waive or modify the fees.

Minimum Local Fee
That effective July 1, 2008, statement 10.J.04 (page 72) be amended to read: “That for the
2008-09 budget year, the minimum local fee for BCTF grant purposes be $325.”

Sharon McIvor Defense Fund
That the Federation donate $10,000 towards the legal defence of the Supreme Court decision in the Sharon McIvor case.

LOCAL RESOLUTIONS
Preparation Time
That the BCTF provide full legal and financial support for Victoria middle school teachers who are in a dispute with their employer over their professional autonomy to decide what they do during their preparation time.

Bargaining
That when the BCTF is negotiating with BCPSEA about an issue that negatively impacts on a specific local or locals that the local(s) be consulted before any agreements are made between the provincial bodies.

Manufacture of Armaments
That the BCTF urge the government to stop the sale of MacDonald, Dettwiler and Associates LTD to Alliant Techsystems of Minnesota (ATK), a company that manufactures armaments.

Opposition to Dues Increase
That an action plan be developed and brought to the 2008 AGM by the BCTF Executive Committee, including lobbying all college councellors to oppose any such motion should the BC College of Teachers plan for a dues increase to pay for criminal record checks, the Public or Employer Registries.

CLASS SIZE/COMPOSITION
Learning Round Table
1. That the BCTF continue to participate in the Learning Round Table only as long as the focus of the meetings is on learning conditions, particularly class size and class composition.

2. That the BCTF, through the Bill 33 review process promised by the premier, demand substantial changes to the legislation that includes the following:
a. ratios and case load limits for specialist teachers
b. reduction in class sizes when students with special needs are included
c. class size limits that provide safety in shop and lab courses
d. firm class size limits in middle and secondary schools
e. reduction in class sizes when there are multi-age/multi-grade classrooms.
f. firm class-composition limits at all grade levels

3. That the BCTF demand the government fully fund Bill 33 and future legislation on class size and composition.

4. That the BCTF make it clear to government that the above demands are being made without prejudice to our provision that these matters should be included in collective bargaining and without prejudice to our position on local bargaining.

5. That the spring Representative Assembly review BCTF participation in the Learning Round Table.

Langley Inquiry
That the BCTF Executive Committee develop a comprehensive provincial action plan to address the recommendations contained in the Langley Special Education Inquiry Report for presentation to the 2008 AGM.

ELECTIONS
The following were elected as CTF AGM delegates:
Laurence Greeff (Langley), Bill MacFarlane (Revelstoke), and Ken Zydyk (Alberni).

AGM NOMINATING CHAIRPERSONS REPORT
Nominating Chairperson Bill MacFarlane announced the nominees for Executive Committee for 2008-09:
Irene Lanzinger (Vancouver Secondary) for president, Susan Lambert (Burnaby) for first vice-president, Jim Iker (Burns Lake) for second vice-president, for members at large: Gail Chaddock-Costello (Langley), Michelle Davies (Central Okanagan), Al Klassen (Richmond), Fred Robertson, (Vancouver Island North), Robert Tarswell (Princeton), and John Wadge (Surrey).

CTF Membership
That the BCTF give notice to withdraw from the Canadian Teachers’ Federation and, concomitantly, that the BCTF work with other teachers’ unions within the Canadian Labour Congress to establish a representative teacher organization.

SUPPORT FOR TEACHING AND LEARNING ACTION PLAN
Marked FSA Booklets
That teachers be advised to not participate in the distribution of marked FSA booklets to parents.

FSA Mandated Testing
That in the event that marked FSA booklets are distributed to parents by administrators, teachers be advised to provide parents with accompanying printed information outlining teachers’ concerns about the FSA and the proliferation of mandated testing.

EXECUTIVE COMMITTEE RECOMMENDATIONS
TOCs for AGM Attendance
That the BCTF cover TOC costs for a local to send delegates and local representative(s) to the BCTF AGM when the following condition has been met:

The local has attempted to negotiate with the board that the employer cover the costs of TOCs for local delegate(s) and local representative(s) attendance at the AGM when the board has implemented a spring break different from that set by the provincial calendar.

Policy 9.D.159
That policy 9.D.159 be amended as follows:

1. In d. replace “teaching conditions” with “working and learning conditions.”
2. Add f. “Teachers are covered under the full provisions of the collective agreement in their
local, including salary and benefits.”

Green Lateral Exchange/Transfer
That the objective of green lateral exchange/transfer between districts be referred to the next round of provincial bargaining.

AGM REFERRALS
Resolution 19 – Exploration Programs
That the BCTF lobby the provincial government to ensure the provision of necessary funding and staffing for Exploration programs at middle school sites.

Resolution 135 – Goals of the BCTF
That an ongoing goal be added to the list of “Goals of the BCTF,” and that this goal be: “to promote the well-being of members through working conditions that nurture ongoing health and vitality.”

Resolution 147 – Parent Presentation Workshops
Referral
That the following motion be referred to the budget-setting process with report back to the Spring RA:
That the Executive Committee be requested to increase the support provided to parent presentations in order to develop additional workshops and cover training and travel costs.

Resolution 158 – International Kyoto Agreement
That the BCTF request that the CTF and member organizations lobby the federal government and members of parliament to have Canada adhere to the International Kyoto agreement.

Recommendation 18 – Canadian military recruitment strategies
That the BCTF oppose Canadian military recruitment strategies which present misleading information eithr visually or verbally, and/or target underprivileged people.

Recommendation 19 – Hydro-electric Power Sites
That the BCTF oppose the privatization of BC water resources and hydro-electric power sites by:
· informing members that this is taking place
· encouraging members to speak out against the process in their communities
· encouraging members to lobby their MLAs and locally elected officials
· writing a letter to the premier.

Recommendation 20 – Foreign Workers
That BCTF lobby government to implement measures to ensure that foreign workers:
1. are given the right to apply for citizenship or landed immigrant status.
2. be able to have spouses and families accompany them.
2. are paid current market wages and benefits for their occupation.
3. are required to take the same tests as workers from other provinces.

Resolution 161 – Status of Women
That the BCTF demand that the federal government restore funding to Status of Women Canada and that the mandate of Status of Women Canada include the goal of equality for all women in Canada.

Resolution 163 – Human Rights Commission
Referral
That the following motion be referred to the Executive Committee for report back to the Spring RA:

That the BCTF call upon the provincial government to:
1. restore the human rights commission with its previous mandate and powers which existed in 1996.
2. fund the commission adequately.
3. restore the office of the human rights commissioner.
4. call upon each school district to establish multicultural, antidiscrimination, and equity divisions under an officer to receive, investigate, and report violations of human rights to the local school board, the local president, and, if necessary, to the commissioner.

Resolution 166 – War Resisters’ Campaign
That the BCTF endorse the War Resisters’ Campaign and make a donation of $5,000 to the campaign.

Resolution 169 – Drug Addiction Study
That the BCTF press the federal and provincial governments to fund an in-depth scientific and social study on the cost/benefit of government distributing drugs to addicts on an ability to pay basis, and further that the BCTF press the opposition parties to commit to such a study should they form government.

Recommendation 23(b) – Policy 49.19.b
That Policy 49.19.b. (p. 159) be amended to read:
b. That BCTF locals work to eliminate the practice of contract teachers calling out, selecting, or expressing a preference for particular TOCs to fill a teacher absence.

Resolution 177 – EI Regulations
That the BCTF encourage members to write letters of support for the UFAWU-CAW campaign to change EI regulations, and that the BCTF lobby government in support of this campaign.

CARRIED MOVED Bowles/Konsmo: That the PRDTU contribute $500 toward Michelle Davies’ campaign. CARRIED MOVED Bowles/Jong-Bowless: That the PRDTU donate $200 toward the cost of “Fantasy Island” hospitality suite at this year’s AGM. CARRIED
